Terms & Conditions

Through using our services, and agreeing to these terms, you acknowledge that you are of legal age of your relevant jurisdiction (over 18-year-old or younger with provided parental consent) and consent to all of these following terms and conditions of Housemate eLearning in relation to the provision of our services (including in subsequent sections, policies or as otherwise advised) for use in all of our websites and platforms.

You also acknowledge that we reserve the right to update or amend these terms at any time, including during an ongoing subscription period. By renewing your subscription for a following period, you acknowledge that you accept any updated terms that have been imposed since the last agreement that have been communicated to you via our service or other communication channels.

Intellectual Property

Through use of our service, you accept that any and all intellectual property (branding, colours, logos, graphics, software, platforms, domains, names, website content, blog posts, images, business concept, training modules, etc.) remains property of either Housemate eLearning or our related partners. As such you understand that any representation, reproduction or commercial use of these items and our services is expressly prohibited unless otherwise approved in writing by an authorised agent of Housemate eLearning.

 

If used without prior authorisation we retain the right to pursue any relevant legal action to either cease any of the above related activities, seek compensation for improper use of our intellectual property, or both. As decided by an agent authorised to represent Housemate eLearning in such proceedings.

Acceptable Use Policy

Everyone that utilises this platform agrees that they do so only in good faith, while respecting the platform and other users. We respond to any instances of unacceptable behaviour of our platform seriously. This may include users found violating any related local or international laws, posting content that is deemed as harmful, abusive, defamatory, explicit or otherwise generally deemed unacceptable by broader society.

 

We also consider unacceptable behaviour to further include using our platform to spread, contain or otherwise interact with any kind of computer virus, malware, or to scrape any data related to the site by any means.

 

Furthermore, attempts to breach website security, evade detection, user security measures, provide false information, impersonate another individual/entity or otherwise attempt to reverse engineer our platform is also considered as unacceptable use of our platform.

 

We reserve the right to suspend or cancel any active subscriptions, plans or any other arrangement for any of these above unacceptable reasons. In these instances, we will reserve the right to not provide any related refunds for un-used services if the account is suspected to have breached the acceptable use of our platform.

 

We also reserve any and all rights to proceed with further civil or criminal charges should that be deemed appropriate by relevant agents authorised to act on behalf of Housemate eLearning.

Governing and operational legislation

Housemate eLearning is a registered Australian business that abides by Australian law, taxation requirements and operational standards. As such we operate under relevant Australian law (including consumer law).

 

By agreeing to our terms and conditions you agree to understand that your use of the service must abide by these terms and Australian law. Any user found not abiding by these relevant regulations may face procedures outlined in our Acceptable Use Policy, as part of these broader terms and conditions for our site.

Under current Australian taxation law of the time this document was written, GST is required to be a component of the total price advertised on our site. As such GST will be charged to any subscriber or under any related financial activities under our site which meets the GST criteria. Under this criteria GST is only collected from any payments for individuals identified as Australian.

Individuals, firms or other entities that inform us are from outside of Australia will not be charged this GST balance, as the service is deemed to be provided outside of Australia and outside relevant GST requirements. These may however be subject to other taxation requirements of the overseas individual’s home country. As such the individual will retain relevant liability as required to ensure they abide by relevant taxation requirements, including by paying tax through our platform where available, or separately.

Through use of this site you agree to make accurate representations regarding yourself, who you work for, what country you live in and any other related information. Individuals or entities may commit an offence if they misrepresent themselves, particularly surrounding personal details, country of residence or other information required for taxation purposes.

 

By agreeing to these terms you understand that the liability for any misrepresentation in this regard is solely on the individual or entity making the false representations, and that Housemate eLearning holds no liability to actions taken regarding incorrect details that have been disclosed to us in the course of our business activities or undertakings.

Ecommerce, Billing, Payments, Subscriptions, Refunds, Donations, Consumer Law and other Financial Activities

As a business registered for operation in Australia. By agreeing to these terms and conditions you are consenting to any relating financial activities occurring between yourself and Housemate eLearning as subject to any relevant and applicable Australian regulation, Australian consumer guarantees or Australian consumer law.

As such, terms regarding refunds are subject to conditions and entitlements as expressed under Australian Consumer Law. As such we will issue refunds if the item has a major failure as described under these regulations, not fit for purpose, doesn’t match any sample services provided, or otherwise as expressed under these regulations and guarantees.

 

We will not issue any refunds for change-of-mind circumstances as individuals may always make any relevant changes to their relevant subscription plan between billing cycles.

Limitation of liability

By agreeing to these terms and conditions, you agree not to hold Housemate eLearning liable for any loss, injury or fatality that occurs as a result of the use of our platform, or that arises from following advice provided on the Housemate eLearning site.

Indemnification

Through agreeing to the terms of use for Housemate eLearning’s online websites and eLearning modules, you agree to not hold Housemate eLearning liable for any and all liability that occurs as per the limitation of liability clause above. Where a case of accident, loss, injury or fatality occurs, you agree not to hold Housemate eLearning liable for any damages which occur as a result of actions which are perceived to be linked or otherwise related to our platform.

Dispute resolution

Through use of our platform and agreement of these terms and conditions, you agree that any and all disputes that should arise are to be communicated through our support email address at purble.support@gmail.com 30 days prior to any further action to allow sufficient time for a response. You also agree to make multiple attempts at communicating with us via this method prior to launching any legal action, in order for our team to make any considered replies in relation to your query. You also agree to accept any and all reasonable requests that are made by an authorised agent of Housemate eLearning in order to resolve any issues in good faith prior to any further legal escalation.

 

Any claims that are made without initially following the above stated dispute resolution pathway, will be considered as vexatious, not in good faith and not in line with these agreed terms and conditions of our service through any subsequent legal process. Any individual or entity that is deemed to be acting as such understand that they open themselves to any subsequent legal or civil proceedings by Housemate eLearning as a result

Miscellaneous

This section and all sections mentioned above are all considered to form the terms and conditions for this site. By agreeing to the terms and conditions and by utilising our site, you agree to the considerations and terms as outlined in all of the sections outlined above.

If one section of these terms and conditions is found to be invalid by the court. The remaining sections of these terms remain enforceable and we retain the right under Australian law to refuse and end any ongoing arrangements if deemed to be in breach of any of the above conditions, or any applicable Australian law, while retaining the right to refuse refunds if the account termination was due to unacceptable behaviour or use of our platform or for any other behaviour deemed by an authorised agent of Housemate eLearning as not in good faith, or considered to breach any of these outlines terms, policies and conditions.
